Terms and Conditions

PLEASE READ CAREFULLY AS THESE TERMS AND CONDITIONS AND THE HOUSE RULES FORM PART OF YOUR BOOKING AGREEMENT:

WELLINGTON STAYS:
All references to Wellington Stays includes all parent, subsidiary, holding or associated companies.

NATURE OF ACCOMMODATION:
Wellington Stays is a provider of temporary accommodation, furnished holiday homes and serviced accommodation. Your booking is not covered by the Residential Tenancies Act nor it's amendements unless otherwise indicated in your booking confirmation.

ACCEPTANCE:
The property remains subject to availability and your booking is not confirmed until all outstanding amounts (including accommodation, security deposit, cleaning fee, credit card fee & any other charges) have been received in full by Wellington Stays.

PAYMENT:
All payments must be made by credit card and incur a non-refundable 4% surcharge. The credit card used to make the booking, must be presented at the time of check-in.

All credit card payments are made via a secure third-party online payment processor. Wellington Stays does not store your credit details or any other sensitive information.

SECURITY DEPOSIT
A hold of $500 will be placed over the booking credit card.

Depending on the property, length of stay or number or guests, a further security deposit of up to $500 may be required and is to cover any loss, damage or breakage that may occur.

The security deposit will be charged to your credit card:
up to 2 days before your confirmed check-in date.

The security deposit will be returned to your credit card:
up to 7 days after your confirmed check-out date, following inspection of the property and settlement of all accounts owing.

Please ensure there is sufficient balance on your credit card to cover the security deposit. Keys will not be handed over until the full security deposit has been received by Wellington Stays.

Please be aware that your liability for any damage or breach is total and not in any way limited to the security deposit amount. Where you are liable for an amount which exceeds the security deposit, Wellington Stays will provide you with an invoice detailing the costs incurred. You must pay this within 48 hours. If you fail to make payment Wellington Stays will immediately refer the matter to its debt collection agency.

CHANGES AND CANCELLATION
No refunds apply if you fail to turn up or decide to leave early, or if you alter your confirmed booking details. Our standard cancellation fees are as follows:

Cancellation more than 30 days prior to your check-in date - no cancellation fee applies (payment processing fees may still apply).

Cancellation 14 to 30 days prior to your check-in date - a cancellation fee amounting to:
50% of the booking value (excluding Cleaning Fee and Security Deposit) applies.

Cancellation within 14 days of your check-in date - a cancellation fee amounting to:
100% of the booking value (excluding Cleaning Fee and Security Deposit) applies.

Payment processing fees may still apply to cancellations.

A request to decrease the number of nights booked is regarded as a cancellation of those nights and our standard cancellation policy applies.

Refunds will only be made to the same credit/debit card or bank account that was used to make payment.

CHECK-IN AND CHECK-OUT
Check-in is from 3pm to 10pm
Check-out is 10am

Anything outside these hours is subject to availability on the day and additional fees apply per hour.

TRAVEL INSURANCE
Wellington Stays highly recommends all guests have travel insurance to protect against unexpected or unforseen changes/disruptions to travel plans.

IDENTIFICATION REQUIREMENTS
A colour copy of ID for all guests must be provided prior to or at check-in.

MAXIMUM GUESTS
The number of guests in the property must not exceed the total number included in your booking.

All guests who are staying at the property must be included in the guest count and any changes must be advised at least 24 hours prior to check-in. Welligton Stays retains absolute discretion and reserves the right to not approve any new guests. Any guests over and above those listed on the booking will result in immediate termination of your booking, with no refund applicable. A fee of $50 per unauthorised guest, per night will apply.

PARTIES/EVENTS/GATHERING/GROUPS
Mind My Guest has a strict no groups/parties/gatherings/events policy in the property. We reserve the right to cancel any booking at any time, if we have reason to believe this rule may be breached. Any breach during your stay will result in immediate termination of your booking, with no refund applicable.

NOISE
The noise level must be inaudible from neighbouring properties at all times. Any breach will result in immediate termination of your booking, with no refund applicable.

KEYS
You will be provided with 1 key/security swipe per property unless otherwise agreed. If any keys/security swipes are lost, Wellington Stays must be notified immediately. In the event of lost keys/security swips, for security reasons, property locks will be changed and you will be liable for the cost of the locksmith, replacement cost of the lock and all replacement keys/swipes. After hours lockouts will incur a minimum fee of $250.

UNINHABITABLE OR UNSAFE ACCOMMODATION
Wellington Stays reserves the right to cancel your booking and provide you with a full refund of any remaining unused stay if the property becomes uninhabitable or unsafe before or during your stay and comparably priced accommodation is not available.

BODY CORPORATE RULES AND REGULATIONS - MULTI UNIT PROPERTIES
You agree to comply with the Body Corporate Rules and Regulations at all times. Failure to comply will result in immediate cancellation of your booking. A copy of the Body Corporate Rules and Regulations will be provided on arrival and all guests are required to familiarise themselves with them to ensure compliance at all times

PROPERTY USE
You must not allow the property to be used for any illegal purposes.

ANIMALS
You must not allow any animals or pets on the property.

SMOKING/VAPING/ILLEGAL SUBSTANCES
Smoking/Vaping and production or consumption of any illegal substances anywhere on or within the property is strictly prohibited. Any breach of these rules will incur a minimum cleaning charge of $500.00.

SMOKE ALARMS
It is illegal to tamper with, remove or disable a smoke alarm. If a smoke alarm is beeping, even occasionally, please contact Wellington Stays immediately. If fire sprinklers have been installed, under no circumstances are you or any other guest to hang any item from the sprinkler or interfere with, touch or tamper them in any way. You will be liable for all costs if you activate a smoke alarm or sprinkler and this results in attendance of the Fire Brigade.

YOUR PERSONAL BELONGINGS
Wellington Stays is not responsible for your personal belongings and you are not entitled to make any claim for loss, damage or compensation of any sort against Wellington Stays.

PROPERTY SECURITY
You must take all reasonable precautions to protect the property and its contents from theft, including ensuring all windows and doors are closed and/or locked whenever you leave the property.

PARKING
If parking is provided, you must comply with all parking regulations and show consideration to neighbours and other vehicles.

CLEANING
You are expected to leave all areas of the property and common areas tidy and return anything that has been moved. Any non-standard or specialist cleaning required after you have checked out will be deducted from your security deposit.

CONDITION OF THE PROPERTY, CONTENTS AND COMMON AREAS
You are responsible for ensuring that all care is taken to prevent breakage, damage or loss to any part of the property, it's contents and common areas (including any caused by odours or cooking smells) during your stay. It is your responsibility to notify Wellington Stays of any issues as soon as they occur.

HEALTH AND SAFETY, PROPERTY REPAIR, MAINTENANCE, EQUIPMENT AND SERVICES
Wellington Stays must be notified immediately regarding any health and safety, repair, maintenance, equipment or services issues and you will allow access to the property for the purpose of any inspection, repairs and/or maintenance. For emergency issues, Wellington Stays retains the right to enter the property immediately and to advise you after the fact that the property was entered.

If any equipment or services are temporarily disrupted for whatever reason, Wellington Stays will make every reasonable effort to arrange for resumption as soon as possible. Wellington Stays is not liable for any loss, damage or compensation which may have been caused or incurred, directly or indirectly to or by you or any other guest.

BREACH OF THESE TERMS AND CONDITIONS
If we believe that any of these Terms and Conditions may be breached or have been breached, we reserve the right to cancel your booking any time, either prior to your arrival or during your stay, with no refund applicable.

Your security deposit may also be withheld to help cover costs. If your booking is cancelled due to breach of these Terms and Conditions, you indemnify Wellington Stays against any liability or loss arising and any cost incurred in connection with your breach. You will be responsible for all costs incurred as a result of your breach.

JURISDICTION
These Terms and Conditions shall be governed by the laws of New Zealand and are subject to the exclusive jurisdiction of the courts of New Zealand.
